DEFECTS LIABILITY AND LIMITED WARRANTY
Our company will issue a defects liability document with a limited warranty after the completion of the project.
A. DEFECTS LIABILITY
In most construction projects, it is likely that at some stage, issues will arise with some or all of the work, and a defect complaint will be made. It is therefore important to understand exactly what is meant by the term ‘defect’, how a contractual ‘defects liability period’ works in practical terms, and whether there is any right to claim damages for covering the costs of rectifying a defect. Outlined below are the answers.
Ordinarily, where the term ‘defect’ is used in a construction contract it refers to work that has not been performed to the standards and requirements of the particular contract. A contract will specify the length of any defects liability period. Anywhere from 6 to 12 months is a fairly common period, although longer or shorter periods are also possible and will depend on the nature of the build, the type of work, and whether any inherent defects may likely take time to become apparent.
Matters to take into consideration in determining if there is a defect may include:
♠ the quality of any work and the standard of workmanship;
♠ whether design directives have been followed and correct materials have been used; and
♠ whether the works have been performed according to contractual specifications and drawings.
A defects liability period is the period specified in the contract during which our company is legally required to repair any defects that have appeared in our work since the date of completion. Usually, a defects liability period will start at practical completion.
B. LIMITED WARRANTY
Warranties are in effect for defects in construction since defects may not show up until well after the last check has cleared.
A (limited) warranty is a written promise (or guarantee (*) by our company to repair or replace a defective product or correct defective workmanship. Our warranty has different time limits, depending on the type of materials used, including some other restrictions.
(*) A guarantee is a more general term, referring to any promise by our company that a product or service will be free from defects.
As its name implies, a limited warranty is limited to just the specified parts, certain types of defects, or other conditions. It is important to fully understand the meaning of "limited" when buying one of our products. The warranty document that you can download at the end of this page will answer your questions,
Our company products will be manufactured under the highest standards of quality and workmanship. We warrant to the original consumer purchaser and parts of this product to be free from defects in material and workmanship during normal use, for a specific number of years from the date of purchase. A replacement for any defective part will be supplied free of charge for installation by you. Defects or damage caused by the use of other than genuine parts from the pour company are not covered by this warranty. This warranty is valid for the original buyer only and excludes product damage due to installation error, product abuse, or product misuse, whether performed by a contractor, service company, or yourself. Our company will not be responsible for labor charges, and/or damage incurred in installation, repair, or replacement, nor for incidental or consequential damages.
C. RESTRICTIONS TO OUR WARRANTY
Prefabworld Bali International is the ONLY prefab wooden house company in Indonesia that issues a defects liability and a warranty certificate. The warranty is the responsibility of Prefabworld Bali International for defects that may occur during the warranty period.
Prefabworld Bali International will provide an implied limited warranty on all goods supplied that the product is free from defects in materials and workmanship and that the product will perform as well as such products customarily do.
D. MAINTENANCE MANUAL
The warranty terms (years per component or element) are subject to proper maintenance, proper installation, and normal domestic use by the PREFABWORLD BALI INTERNATIONAL care instruction manual. You may download the maintenance handbook at the end of this page.
